چالش های دادرسی کیفری اتباع خارجی در نظام حقوقی ایران و افغانستان

چکیده
دادرسی کیفری اتباع بیگانه در نظام عدالت کیفری ایران، ازجمله مسائلی است که با افزایش روزافزون مهاجران قانونی و به ویژه غیرقانونی با چالش های متعددی مواجه شده است. این پژوهش به شیوه توصیفی تحلیلی و با استفاده از منابع کتابخانه ای انجام شده و پس از بررسی ابعاد مختلف بزهکاری و بزه دیدگی اتباع بیگانه در ایران و افغانستان و چالش های این حوزه، راهکارهایی جهت ارتقاء دادرسی کیفری اتباع بیگانه ارائه می نماید. یافته های پژوهش در حوزه بزه دیدگی اتباع خارجی در ایران نشان می دهد که حق دادرسی اتباع بیگانه، تعیین وکیل تسخیری و پرداخت دیه بزه دیده از بیت المال برای اتباع بیگانه نیز وجود دارد. همچنین در فرض بزهکاری، اتباع بیگانه در ایران به مانند سایر متهمان از حقوق تعیین شده در قانون آیین دادرسی کیفری برخوردار هستند، اما این حقوق در خصوص اتباع بیگانه غیرمجاز در دو فرض بزهکاری و بزه دیدگی، با چالش های متعددی مواجه است که در مواردی نیازمند اتخاذ سیاست جنایی افتراقی است.Challenges of the Criminal Proceeding of Foreign Nationals in the Iranian and Afghan Legal System
The Criminal proceeding of foreign nationals in the Iranian penal justice system are among the issues that have faced numerous challenges with the increasing number of legal and especially illegal immigrants. This research was conducted in a descriptive-analytical method and by using existing library resources, it presents solutions to improve criminal proceedings against foreign nationals, after examining various dimensions of delinquency and victimization of the foreign national in Iran and Afghanistan and the challenges in this area. The findings of the research in the area of victimization of the foreign national in Iran show that foreign nationals also have the right to a trial, the appointment of a defense lawyer and the payment of victim’s blood money from the state treasury. Also, in the case of delinquency, foreign nationals like other defendants have the rights specified in the Criminal Procedure Code, but these rights face numerous challenges in regards of unauthorized foreign nationals in the two cases of delinquency and victimization, which in some cases require the adoption of a differentiated criminal policy.
